U.S. Supreme Court declines review of UI dental hygiene case

IOWA CITY, Iowa -- The University of Iowa received word Thursday, Feb. 27, that the United States Supreme Court has declined to review lower court decisions which said that the UI did not discriminate against three women faculty members in deciding to close its dental hygiene program and that the UI did not retaliate against the faculty members when they objected to that decision.

The Supreme Court's action lets stand a July 19, 1996, decision by the 8th U.S. Circuit Court of Appeals, which found that the UI did not retaliate against the three professors. That ruling reversed a decision by the trial court, which had said that the UI had retaliated against them by closing the department as an administrative unit while the program was being phased out. In reversing the lower court ruling on the retaliation charge, the appeals court also overturned the lower court's award of attorney's fees and costs to the faculty members.

The appeals court also upheld the trial court finding that the UI did not discriminate against the professors in making the decision to close the dental hygiene program.
